Terms & Conditions of Business

 

Cancellation and Returns

In accordance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which replaced the Consumer Protection (Distance Selling) Regulations 2000, you may cancel your course anytime within fourteen days after you receive your course materials whether in hard copy or online.

 

To cancel your course you must send a signed, written notice via recorded delivery to  Course Cancellations at our office address in Cambridgeshire (cancellations by telephone or email will not be accepted).

 

In line with The Consumer Rights Act 2015, you also have a 14 day right to change your mind and get a full refund for digital content, i.e. Online courses, that you have purchased, unless you have already started to download it.  In the case of a classroom based course, where attendance is obligatory, your right to change your mind applies, unless there is less than 21 days to the start of the course, this is due to the expense and work required prior to courses starting.

 

You must also return any course related hard copy materials in their original packaging to us at your own cost and risk, and in a re-salable condition. We strongly encourage you to send the course materials by recorded delivery so that you can track the return.

 

Upon receipt of cancellation notice and returned course materials at our office address – and provided the course materials are, at our sole discretion, in re-saleable condition, we will process the refund due to you within thirty days of our receipt of your written notice of cancellation.

 

All cancellations will be subject to a 3% cancellation charge for administration, which would be deducted from any refund due to you.

 

Outside the standard Terms and Conditions cancellations may be considered on a case by case situation. In this case a cancellation fee equating to a 50% of the remaining course balance will be charged for online, distance learning and blended courses.  In regard of courses which are predominantly classroom based, including but not limited to our Hypnotherapy Professional Diploma Course, a cancellation fee equating to 65% of the remaining course balance will be charged, providing the course is cancelled prior to unit 3.  Cancellations of these predominantly classroom based courses, after unit 3 will be due no refund under any circumstances.  This fee will be requested as a one-off payment to settle the account.

What we need to know 

 

For us to be able to handle your query effectively, we will need the following information from you:

  • Your full name and student number (if applicable)
  • The full name of the course you are studying
  • Full details on what your query or concern is

We are unable to process queries, concerns or complaints where:-

  • They are sent to us anonymously
  • The sender wishes to remain anonymous 
  • The concern or complaint is raised more than 30 days after the initial issue/concern has taken place 

 

How we will deal with your complaint or query

 

STAGE 1

Advise the Indigo Inspirational Training Ltd member of staff you work most closely with of your query or complaint and give them the opportunity to resolve the matter directly. Due to the nature of some queries this could take up to 7 days investigate fully. If you remain unhappy with the outcome, or how long it is taking, or if you feel it inappropriate to raise  the issue with this staff member, please proceed to Stage 2.

 

STAGE 2

Contact us via admin@indigotraining.org.  We will aim to give you an answer as soon as possible and if we cannot, you will receive an update or resolution within 7* working days.

 

STAGE 3

If you remain unhappy with the outcome of your query or complaint, you will be required to put your concerns in writing and send a letter to the following address: Student Services, Indigo Inspirational Training Ltd, Unit 4a, Grange Farm Units, Abbots Ripton, Cambs PE28 2PH.

The original investigation of your query or complaint will then be looked into by a senior member of staff, along with the resolution offered.  They will then speak to the relevant staff members with regards to the actions taken to date. This process will be completed within 14* calendar days and a response will be sent to you with regards to the investigation and outcome.  

 

*This may be longer over public holidays and Christmas/New Year period, or due to circumstances beyond our control.

How your query or complaint will be dealt with.

 

There are some exceptions to this process. Complaints or queries involving discrimination, prevent or safeguarding issues should go straight to Stage 3. These areas are broken down into more detail below:

Discrimination based on:

  • Age
  • Sex
  • Race, religion or belief
  • Sexual orientation
  • Disability
  • Pregnancy or maternity
  • Marriage or civil partnership
  • Gender reassignment

The government’s counter terrorism strategy (Prevent):

  • Stopping a terrorist attack that you may have become aware of
  • Stopping people becoming terrorists, if you are concerned about someone who may be in this situation and wish to make a complaint
  • Radicalisation within an educational environment

Any of the following, relating to yourself or another person (Safeguarding):

  • Physical abuse
  • Sexual abuse or inappropriate conduct
  • Emotional or psychological abuse or bullying
  • Financial abuse

 

External query/complaint review

Stage 3 is the final stage of internal process. If after following the previous stages and processes, you remain unhappy with the outcome of your query or complaint, you will be able to appeal to an External Complaints Officer, whose details we will provide you with.  If you wish to make an appeal, the External Complaints Officers decision will be final and there will be no further appeals.

 

Intellectual Property

All intellectual property rights relating to the course materials are either owned by or licensed to us. Copying, adaptation, selling, posting to social media (or similar) or any other use of all or any part of the course materials without our express permission is strictly prohibited.

 

Payments

All outstanding debts to us must be made before we will issue you with a diploma or certificate.

 

We reserve the right to refuse enrolment on any of the courses we offer.

 

If you are paying by instalments, payments must be made on the date agreed prior to the start of the course.  Please note that a £25 admin fee will be charged for any late fees, or payments that we need to chase. If 2 payments are missed, you will be suspended from your course until fees are up to date.  You will however still remain liable for the full course fees, whether you continue with your course or not. 

 

We aim to be sympathetic to all circumstances, however, there are certain costs and expenses incurred by us in the creation, marketing, marking of courses as well as admin costs associated with registering and managing students, therefore we reserve the right to charge the fees agreed to by you upon signing up for any of our courses.

 

Disclaimer of Warranties and Limitation of Liabilities

We warrant that we will carry out the service to you with a reasonable level of care and skill.

 

If you require any changes to these terms, please request such changes in writing to the address above.

 

Any liability under any agreement between you and us shall be limited to any sums paid by you to us.

 

As far as permitted by law, we shall not be liable to any person for losses or damages that were not reasonably foreseeable and that were not caused by any breach on our part. We shall not be liable to any person for any direct or indirect loss or damage as a result from your course enrolment. Any liability that does arise will be limited to the course fee paid.

 

We are not qualified to provide you with advice regarding health problems. If you require any such advice, we recommend you seek the opinion of your doctor or any other medical practitioner. Any holistic health care advice we do provide should be treated as congruent to, and not an alternative for, accustomed health care.

 

Practical Training – Classroom and Distance Learning Courses

The topics covered during the practical training will be as close as possible to those stated on the website. However, if we are obliged to make any minor changes to your practical training we reserve the right to do so and will inform you as soon as possible.

 

Any materials offered free with the course, will be given to you as appropriate on or throughout your training days. 

 

Distance Learning Courses

All outstanding course fees must be paid in full at least one month before your practical training is due to commence, this only applies when the practical training is at the end of the course.

 

Your responsibilities

We affirm that the course materials will meet a satisfactory level of quality; however, we do not affirm that they will be error free. You are responsible for inspecting the course materials and informing us about any oversights as soon as is reasonably possible following delivery.

 

The majority of our courses have a time limit for completion.  Generally, this will be either 6 or 12 months, excluding some classroom based professional qualification courses.  Where there are exceptions to this, it will be clearly stated on the course information page.  

 

We encourage students to complete their course within these time limits in order for the course to remain current and for you to stay motivated. If you wish to take a break from your course, which will mean it is not completed within the time limit, as £35 re-activation fee will apply.  This fee may be waived if the break is due to serious medical conditions (proof of condition/treatment may be required). If you simply do not finish your course within the specified time limit a fee of £25 will be applicable for each additional month you require.  

 

Taking a break from your studies does not apply to classroom based, obligatory (blended learning) attendance courses, as we cannot guarantee if/when the course will be run again or the location of future courses.

 

You are required to notify us by email of any changes to your postal or email address.  Certificates/Diplomas will be issued in the name provided during your enrolment. If you marry, or for other reasons wish to use a different surname, you will need to provide a reason and legal proof (such as a marriage or divorce certificate).

 

All our courses are at present only available in English and therefore all submitted work must reach a reasonable standard of English.  The higher the course leave you undertake, the higher the potential expectation.

 

General

All our courses are for educational, self advancement, self development and self improvement purposes.  We do not promise or imply in any form whatsoever that any learner will achieve any kind of paid or self-employed employment or any type of future qualified career as a result of undertaking our courses.  This responsibility lies solely with the learner.

 

We cannot guarantee that if Government legislation changes in the future, that qualifiiations that currently allow the holder to gain professional liabiity, membership to governing and accrediting bodies or employment (of their own gain) will remain acceptable.

 

Data Protection 

We will never sell your information and will hold and manage it according to current Government regulations.

We will, where possible, provide additional support to ensure fair access to all.  This may include notes in a larger font, agreement that a scribe may attend classes (provided they agree to our confidentiality rules), additional time to complete homework tasks (for homework assignments required during our predominantly classroom based courses).

 

Health & Safety Policy – attended courses only

Indigo Inspirational Training Ltd recognises that health and safety are important and are committed to providing and maintaining a healthy and safe environment for our staff, learners and visitors.  

 

Staff, learners and visitors will be responsible for:-

  • Taking reasonable care of their own health and safety and that of others affected by their acts or omissions. 
  • Following guidance and advice from Trainers, Tutors or Managers (as appropriate). 
  • Ensuring that any equipment used is done so in a safe and appropriate way (if unsure please check before use). 
  • Not intentionally misusing or doing anything that will affect the health, safety or welfare of staff, learners or visitors.
  • Reporting any problems to the Trainer, Tutor or Manager (as appropriate).

Learners will:-

  • Be introduced to premises layout, health & safety requirements, fire drills, walfare provision and first aid procedures at the start of their first day of training.

We acknowledge that where training takes place in a hired venue where that venues health and sfety policies and procedures differ from ours, those procedures may supercede ours for the period/s of hire.
